Dispute over Unfair Competition between Beijing Sanju Environmental Protection and Shandong Sanju Environmental Protection

In this case, Beijing Sanju Environmental Protection (the plaintiff) and Shandong Sanju Environmental Protection (the defendant) are both engaged in the production and sales of products and equipment related to the chemical industry, and there is a competitive relationship between them. Beijing Sanju Environmental Protection is a well-known enterprise in the field of chemical environmental protection. Through long-term promotion and use, "Sanju Environmental Protection" has gained extremely high market recognition as the plaintiff's business name. The appearance of the products and equipment displayed on the defendant's website is consistent with those of the plaintiff, and the defendant also uses the words "Sanju Environmental Protection". The main part of the defendant's website domain name, "sdsanju", is also very similar to the plaintiff's domain name. At the same time, when registering the enterprise name, the defendant did not make reasonable avoidance of the prior rights enjoyed by "Beijing Sanju Environmental Protection". The court ordered the defendant to stop the unfair competition behaviors such as confusion and false promotion involved in the case; change the enterprise name; cancel the company domain name, and publish a statement in a nationally distributed authoritative chemical industry newspaper to eliminate the adverse impact on the plaintiff. At the same time, the court ordered the defendant to compensate the plaintiff for economic losses of 200,000 yuan and reasonable litigation expenses of over 80,000 yuan.
