Case Background: In September 2022, it was detected that the competitor, Arctic Xiongxin, filed a patent application for an invention related to multi-chip interconnection integrated circuit technology (Patent Application No. 202210890029.6, titled "Integrated Circuit Based on Multi-Chip Interconnection"). The application contains a total of 16 claims. The first examination opinion notice only pointed out that independent claim 1 and its dependent claims 2-3, 6-8 lack inventiveness. Under normal circumstances, the target patent will be granted after the patent applicant responds, and the patent protection scope will fully cover the client's existing products.
Our work: As this case was submitted for pre-examination, when we received the client's commission, the deadline for a first response was approaching. There was a high probability that the patent would be granted. Our lawyers found four more relevant prior art documents within three days, which could effectively deny the inventiveness of all the claims of the target patent. After thorough communication with the client, we promptly completed and submitted the public opinion. We also had two phone conversations with the examiner, further explaining the technical content of the prior art documents and assisting the examiner in clarifying the inventive step review process. Eventually, the examiner directly rejected the target patent in the second examination opinion notice by using the prior art documents provided by us.
