The Reexamination and Invalidation Division of the China National Intellectual Property Administration (CNIPA) recently released the 2023 Annual Compilation of Key Decisions on Patent Reexamination and Invalidation. Four cases jointly handled by Beijing Sanju Sunshine Intellectual Property Agency Co., Ltd. and Beijing Sanju Law Firm were selected for inclusion. These cases are: the invalidation of the invention patent titled “An Operating Machine,” the invalidation of the invention patent titled “Acidic Water-in-Oil Emulsified Liquid Seasoning / Sesame-Containing Acidic Liquid Seasoning,” and the invalidation of the invention patent titled “A Safe Lithium-Ion Battery Cell and Safe Lithium-Ion Battery Pack.” Among them, the lithium-ion battery case was also included in the “2023 Top 10 Patent Reexamination and Invalidation Cases” by CNIPA.
The Compilation features 53 cases of typical significance and 58 key decision points, selected from 7,700 invalidation cases and 65,400 reexamination cases concluded in 2023 by the Reexamination and Invalidation Division. The release of this Compilation provides a focused explanation of the legal applications in patent reexamination and invalidation cases and showcases the latest practices in patent examination across various technical fields.
